Rules

Registration and Arrival Check-In Procedure - Check-In Time: 2 p.m. - Check-Out Time: 11 a.m. - While each park attempts to accommodate your exact spot request, the on-site manager makes the ultimate decision regarding spot placement. Resident Requirements - Desert Springs RV Resort is designated as an all-ages park. - All potential tenants and/or occupants of the Park must submit a Park-provided application for residency for approval by Park Management, must meet the Park’s adopted income, credit, and criminal background screening criteria to qualify for residency, and must pay any required application fees, which are non-refundable. - Upon meeting all qualifications, all tenants (each a “Resident”) must sign a rental agreement before residing in the Park. - All approved occupants of a space must either be listed on the rental agreement as an occupant or must sign an occupant addendum with the Resident and the Park before they may reside in the Park. - Only registered, approved tenants, who have signed a rental agreement with the Park, and registered, approved occupants, and their guests to the extent permitted herein and in the rental agreement, may occupy a home in the Park. Laws and Disturbances - Residents shall comply with all applicable laws, ordinances, and regulations of the State of Arizona and Mohave County. - Acts, which place Park Management or the Owner of these premises in violation of any law or ordinance of the City, County, or State, will not be permitted. - The creation of a nuisance, annoyance, indecency, disorderly conduct, or any conduct that disturbs the quiet enjoyment of other Residents will be cause for expulsion of the offending party. - Radio, television, or similar equipment shall be kept at volume levels which will not, at any time, annoy or disturb other Residents. - Loud noises or boisterous parties will not be permitted at any time. - Park Management must and will insist upon strict compliance with this rule and shall maintain the sole right to determine when and whether this rule is violated. - Residents are responsible for their own conduct and for that of their occupants, guests, visitors, and invitees. - Residents and their occupants, guests, visitors, and invitees must conduct themselves in a reasonable and respectful manner at all times in the Park. - Offensive or inappropriate conduct towards anyone, including but not limited to other tenants, occupants, guests, visitors, invitees, or Park Management, employees, or staff, will not be tolerated and is grounds for termination of tenancy. - Residents, their occupants, guests, visitors, and invitees may not yell, curse at, or behave inappropriately towards Park management or staff. - Residents and their occupants, guests, visitors, and invitees must not interfere with the management or operation of the Park. - Park Management has the right to prevent access to the Park and to remove anyone other than approved residents deemed objectionable. - Objectionable persons include but are not limited to persons previously denied residency at the Park for reasons of prior evictions (unrelated to a non-payment of rent) or criminal history; persons not qualified for residency of the Park for reasons other than inability to pay rent; persons previously evicted from the Park for reasons other than non-payment of rent; persons engaged or previously engaged in criminal activity in the Park; persons who have previously materially violated Park rules or have been disruptive in the Park. - Tenants permitting guests who are objectionable to be on the premises are subject to a notice of termination of tenancy for material non-compliance with Park rules. - Park Management reserves the right to trespass on the Park on anyone who is not an approved tenant or occupant. Rental Agreements, Architectural Standards And Controls, Statements Of Policy - The separate Statements of Policy, Rental Agreement, and Architectural Standards and Controls are a part of these Park Rules and Regulations. - Failure by a Resident to comply with these Park Rules and Regulations will constitute a breach by such Resident under the terms of the Rental Agreement. Lots And Landscaping - There are no lot lines separating spaces; the configuration of each space is designated by Park Management. - Residents will maintain their site year-round in a clean, safe, well-kept, and attractive condition, including the side, rear, and front yards extending to the street and gutters in front of the Resident’s space. - If a site is neglected, Park Management may hire a contract landscaper and require the resident to pay for these services. - This property contains extensive underground utilities; therefore, no building or digging of any kind is permitted without written permission from Park Management. - Replacement of shrubs, plantings, potted plants, and flowers is permissible. - It is expected that high-maintenance plants will be maintained on a regular and consistent basis by the Resident. - Palm trees (pygmy palms are acceptable but must not be permitted to exceed 8 feet in height), deciduous trees, and fruit trees are not permitted on resident lots. - If plants and other vegetation are not properly maintained, Park Management reserves the right to ask the Resident to remove these planting materials. - Trees in the Tenant's space are part of the space. - Pursuant to ARS § 33- 1451(A), Tenant is responsible for maintaining trees on the space, including, but not limited to,o trimming as necessary to ensure the health of the tree and to avoid safety hazards. - The landlord is responsible for the trees in the common areas. - Tenant may not remove or disfigure a tree without prior written permission from Management. - Unauthorized removal or destruction of a tree on the space not originally planted by the Tenant constitutes destruction of valuable Landlord property and can be cause for immediate eviction. - Decorative and retaining walls must be of stacked rock. - All such walls require prior written approval of the Park management. - Trespassing on or through other Manufactured Home sites is prohibited. - Wrought iron fencing is allowed in backyards only and cannot exceed 3 ft. and must be tan. Manufactured Homes - Park Management reserves the right to approve or reject the type, size, and appearance of all Manufactured Homes and their accessories. (Refer to Architectural Standards and Controls, which set forth all such requirements.) - All Manufactured Homes and storage sheds must be kept in good condition. - All wiring and plumbing must comply with local and state requirements. - All electrical, water, and sewer connections must be kept in good, safe, and leak-proof condition at all times, and in compliance with all State and Municipal laws. - Additions, remodeling, or alterations of the exterior of Manufactured Homes are prohibited unless written permission is obtained from Park Management. - All contractors hired to perform work in the Park must be licensed, bonded, and insured. Resident or contractor must apply to the appropriate building department for all applicable permits (s). - Aluminum foil, signs, except for one (1) 12” X 18” “For Sale” sign as provided for in the Arizona Mobile Home Parks Landlord Tenant Act, or fiberglass sunscreens are not allowed in the windows of the home. (Refer to Architectural Standards and Controls for permitted sunscreens.) - Only homes with heat pumps or A/C Units are permitted and are prohibited from placement in windows or through the side or front of any home. - No ductwork is allowed on top of the roof. Heat pump or A/C units are to be placed on the ground at the rear of the home, as much out of view from the street as possible. - Evaporative coolers are not allowed. - If a glassed or screened room (Arizona Room) is added, an air conditioning unit is permitted and must be through the wall toward the rear of the home and must be set at or near ground level. - Screened-in/glassed-in patios must have prior written approval of Park Management. - Propane gas will be permitted on your site for personal use barbecues (maximum 7.5-gallon tank) only. - Responsibility for any damage and all liability shall rest solely with the Resident. - Small wind chimes are permitted as long as the noise does not disturb a neighbor. - If it does, the wind chime must be removed. - Fireplaces are not permitted. - Outdoor chimineas, enclosed fire pits, etc., are permitted on the rear patio areas but must be approved by Park management. Patios And Carports - Only standard patio furniture is allowed in the backyard of the home. - Interior stuffed furniture, beds, appliances, etc., are not permitted outside the home, including the front and back yard. - Storage is not permitted on the patio, carport, or elsewhere on the site. - Patio and carport must be kept clean and attractive. - Any vehicle dripping gasoline, oil, or other fluids must be repaired immediately. - Drip pans may be used if kept clean. - Driveways are to be kept clean of fluid stains if drip pans are not used. - Treatment of concrete for oil protection in the carport area (only) is permitted, and must be of a concrete color approved by management. - Patio areas may be covered with cool decking, and color and pattern must be approved by management. - You may extend your patio with pavers as long as you have pre-approval in writing from Management and follow the rules outlined in the Architectural Standards and Controls. - Lattice of any kind is not permitted in the Park. - Bicycles, motorcycles, or golf carts must be parked in the carport area and not on landscaped areas. - Mechanical work may not be performed in the carport or elsewhere on your site. - No repairing of motor vehicles, including changing of oil, is allowed on any of the Manufactured Home sites or streets within the Park. - Patio and garage sales are prohibited, except for the bi-annual Park-wide event. Antennas - No exterior radio or television antennas may be erected on the home or the site except for a satellite dish or a Wi Fi antenna. - A satellite dish must be placed in the rear 1/3 of the home. - It should be placed as inconspicuously as possible from the street. - WiFi location must be approved in advance by the Park Management. - Cable wiring must run under the home or along the footing and cannot be run over the roof. - Conduit and cabling must be painted to match the home. Trash And Waste Disposal - Park dumpsters are located within the Park and are for resident use only. - Residents are responsible for delivering their trash to the dumpsters. - Disposal of large items, such as water heaters, appliances, coolers, old furniture, mattresses, etc., must be taken to the landfill by the Resident. - Residents may not dispose of business or commercial trash in the Park. - “Dumpster diving” is prohibited. - To prevent clogged sewer lines and extend the life of sewage and septic systems for the Park, do not flush sanitary napkins, disposable diapers, Kleenex, paper towels, cigarette butts, cooking grease, or any other undissolvable materials or foreign objects down toilets, sinks, or garbage disposals. - Instead, all such items should be deposited in the trash. - The costs of clearance of stoppages or repairs of sewer lines and sewer and septic systems caused by the Resident’s negligence or improper usage, or misuse are the responsibility of the Resident. Storage Sheds - Sheds must be constructed with minimum dimensions of 8 feet X 8 feet and a maximum dimension of 8 feet X 10 feet (prior written Management approval required before adding a shed), and must allow for at least one (1) car to park in the driveway or carport. - Sheds must be located in the carport and must be constructed of wood and sided with T1-11 or stucco, covered in the same style as the home and of the same color. - The shed may be located on the rear of the patio with the prior written consent of Park Management. - The shed must be completely covered by the carport. - Metal and plastic sheds are expressly prohibited. Traffic and Parking - Parking of vehicles is not permitted on landscaped areas or vacant sites. - Street parking is permitted for the loading and unloading of recreational vehicles during daylight hours. - Resident’s visitors may park in front of the Resident’s home for short visits, not to include overnight. - Driveways may not be blocked at any time. - Additional temporary parking is available in visitor parking areas. - Car/RV/ATV washing is not permitted at the Resident’s home. - Motorcycles, motor scooters, ATVs, and four-wheelers are permitted but must be kept in the carport or garage area in a neat and orderly fashion. - Traffic signs, including speed limit signs, must be obeyed for safe traffic movement. - Loud vehicular noise is not permitted. - Overnight parking of travel trailers, motor homes, trucks, commercial vehicles, etc., is not permitted on the street. - Small commercial work vehicles, small van-type RVs, and other unusual vehicles can be parked in carport areas if they are small enough to fit appropriately and have been approved by Park Management. - Standard transportation pickup trucks, SUVs, vans, etc., are permitted in carport areas. - Overnight RV or moving van/trailer parking in the Park for the purpose of loading or unloading must obtain prior Park Management approval. - No underage use of golf carts permitted in the Park at any time. Pet Policy - No pets may be kept in the Park without the permission of Park Management. - Commonly accepted household pets such as dogs, cats, and birds will be the only animals permitted on the premises. - Pets cannot be kept, bred, or maintained for commercial purposes. - Acquiring a pet after move-in requires written permission from Park Management. - All pets must be registered at the Park Management office. - Barking, growling, snarling, crying, howling, and other such noises which disturb other tenants are cause for revoking permission to keep a pet. - Aggressive or vicious behavior is cause for revoking permission to keep a pet. - Residents are limited to two (2) indoor pets per home. - Special exceptions may be made with written permission from Park Management. - Certain Dog breeds, such as Chows, Pit Bulls, Rottweilers, and Dobermans, or mixes with aggressive or potentially aggressive nature, are prohibited. - Park Management’s opinion of the breed shall be final in the event of disputes over the animal’s breed. - Pets must always be on a leash when walking around the Park. - Pets cannot be left unattended on a leash outside. - Pets are prohibited from the clubhouse, recreation facilities, and common amenity area. - If Park Management is unable to identify or contact the pet’s owner, Park Management reserves the right to have any stray animal or unattended pet picked up by Animal Control. - Outside kennels are prohibited. - All pets must be kept indoors at night. - Pets that bark or disturb neighbors are prohibited and will be removed from the Park. - Residents shall be responsible for the cleanup after their animals. - All residents with a pet must sign a separate Pet Agreement for each pet they have or bring in. - Exceptions to the Park’s pet restrictions will be made when necessary for assistive animals needed by disabled Residents of the Park. Solicitation - Solicitors will not be permitted in the Park at any time. - No door-to-door solicitations of any kind are permitted. - While meetings at residents' lots are not affected by this rule, a solicitation by one resident without prior invitation of another resident is prohibited by this rule. - If you observe a solicitor, please notify the Park Office Park Common Facilities - Park facilities are provided for the exclusive use of Park Residents and their guests. (Subject to guest limitations). - All Park facilities are for residents and their guests’ enjoyment and are used at their own risk. (Subject to guest limitations). - Residents may reserve certain portions of the Park Facilities for their personal social activities, but under no circumstances shall they be used for residents’ financial gain. - Resident functions will be given first priority. - Request for use of the facilities for personal social activities must be booked through and approved by the Park Manager’s Office. - A refundable cleanup/damage fee is required. - Proof of liability insurance and appropriate permits shall be required for parties at which Alcoholic beverages will be served. - Appropriate attire must be worn in the clubhouse. - Shirts and shoes must be worn. - Park Management may post reasonable rules for common facilities, and reserves the right to change the rules as needed. - Excessive use of alcoholic beverages, boisterous conduct, or destruction of property is expressly forbidden. - Closing hour for all facilities is 11:00 P.M., except for special events approved by Park Management. - Smoking is not permitted within any of the Park buildings or within 50 feet of the Park Amenities Center. Guests - Guests (including guests paying a nightly fee to Resident) may stay in Resident’s Manufactured Home when Resident is absent from the residence provided Resident provides notice of the stay with Park Management including names and contact information for such guests, at least one (1) of whom must be a person who has achieved the minimum age to reside in the Park. - Guests must register with the Park Office immediately upon arrival and provide a picture ID. - Guest vehicle(s) must also be registered with the Park Office. - Guest(s) not prearranged for by the Resident and/or not registered with the Park Office will not be permitted to remain in the Park. - Resident is solely responsible for their guest(s) and their guest(s) acts or actions. - Guests may not cause the Resident to exceed occupancy limitations set forth in the Resident’s lease or these rules or other applicable law. - Registered guests or guests accompanied by a Resident may use the Park facilities and must show their guest pass upon request. - Guests will not be permitted to stay longer than thirty (30) days in any 365-day period. - If a guest is planning to stay for longer periods, they will be required to be approved and pass a background check as a regular resident. - Immediate family or other guests using the facilities without the Resident in occupancy or accompaniment must abide by all rules and regulations. - Residents will be held responsible for the conduct of their guests. - To avoid any embarrassment or misunderstanding, be sure to explain these rules and regulations to your guests. Responsibility - Park Management and the owner of the Park are not responsible for any loss or losses resulting from fire, theft, or accident. - Residents are responsible for all damage caused by their negligence, that of their guests, and any damage or injury caused by their pets. Courtesy Services - The Park cannot and does not guarantee residents' security. - Resident agrees and acknowledges that the Park has no duty to provide security services to the Park. - The resident shall look solely to the public police force for security protection. - The Park is not liable to the resident for failure to provide adequate security services or for criminal or wrongful actions by others against the resident, the resident’s relatives, or the resident’s guests. - All Residents must have a common parking decal placed in the lower left corner of the windshield of their motor vehicle. - All guests not in the company of a Resident or occupant listed in the rental agreement must be in possession of a guest pass when they are in any common area and present it when requested. - A Resident who thinks they have observed an unauthorized person(s) in the Park should notify Park Management. - Residents are also encouraged to report any violations. Mail - Mail services are provided by the United States Postal Service at the Littlefield Post Office. - A P.O. Box will be assigned to Residents with a copy of the lease agreement. - Mail addressed to residents or spaces at the Park Office will be returned to the sender as undelivered. Sales, Subleasing, and Permitted Use - The name, Desert Springs Communities, shall not be used for any purpose of advertisement or sale of automobiles, Manufactured Homes, or other merchandise without Management approval. - A Manufactured Home may not be removed from its site and replaced by another home without specific prior written approval of Park Management. - Manufactured Home sites may not be transferred or sublet by Residents without prior written Park Management approval (except that, for clarification, allowing a Manufactured home to be used by short-term guests paying a nightly fee and staying 30 days or less during any 365-day period is permitted). - If anyone violates this rule, they are subject to eviction from the Park. - Your Manufactured Home is to be used as a single-family residence only. - Residents shall not conduct a business from his/her Manufactured Home or within the Park, including non-family daily or nightly babysitting services for persons located outside the park. - Informal non-family babysitting services among neighbors within the park are permitted. - Also, allowing guests to stay in your Manufactured Home for a nightly fee for a period that does not exceed more than 30 days in any 365-day period is permitted (subject to compliance with the other guest-related rules herein). - All other uses are not permitted. Removal Of Home From Park The following procedures have been adopted pursuant to A.R.S. 33-1485.01 and apply to the removal of a Manufactured Home from the Park: - The resident may remove the Manufactured Home from the Park as provided in the statute. - Resident must provide the Landlord with a Notice of Removal of Manufactured Home From Park not less than thirty (30) days prior to move-out (this time is necessary to enable the Landlord to make arrangements to enable the move-out). - Resident MUST be current on all fees, lease rent, late fees, and utilities in order to remove the home. - The resident must designate a person or entity that will be responsible for the move-out. - If this responsible person or entity is not licensed as a contractor by the Registrar of Contractors or the Department of Fire, Building, and Life Safety, a move-out deposit or surety bond of $1000.00 (less any security deposit of the Resident that is being held by the Landlord) must be posted with the Landlord. - When home is removed, all accessory structures such as sheds, awnings, carports, fencing, Arizona rooms, and all concrete must also be removed unless the Landlord agrees to the contrary in writing. - The site must be left clean, free of trash, building materials, and construction debris. - All holes and depressions must be filled in with clean fill dirt. - The site must be graded and leveled at approximately the same level as the original elevations. - The resident is responsible for providing clean fill dirt. - Forms for these purposes are available in the Park Office. Office Hours - The Park Office is open Monday through Friday, closed Saturday, Sunday, and Holidays. - Specific hours are posted at the office. - All business is to be conducted during these hours, except emergencies, which may be attended at any time. - In the case of a medical emergency, call 911 first. Revisions To Park Rules And Regulations - Desert Springs Communities reserves the right to amend, revise, and add to the Rules and Regulations of the Park at any time as it deems such amendments, revisions, or additions are in the best interest of the Park and its residents. - Notice of any such changes shall be distributed by first-class mail at least thirty (30) days in advance of the effective date in accordance with ARS 33-1452. On-site Managers - On-site Managers, as representatives of Desert Springs Communities, are instructed to exercise fairness and justice in carrying out their duties to the Residents of Desert Springs Communities. - Their actions with regard to requests, responses to complaints, etc., are predicated upon maintaining a safe and harmonious environment throughout the Park. - Should an occasion arise in which a resident wishes to appeal a decision made by Park Management or a guideline set forth in these Park Rules and Regulations, please contact the Park Manager. For Sale Signs - One (1) “For Sale” sign, no larger than 12” wide x 18” long, is allowed to be placed on the inside window of or on a Manufactured Home, stating the name, address, and telephone number of the owner or agent for the Manufactured Home. - In addition, there will be a display board for posting your homes along with contact information. Recreational Vehicles - Resident and Resident’s contractors and employees may perform work in the RV during daylight hours; otherwise, it is considered to be in storage and is not to be occupied. - Restricted use of Generators for construction purposes only. - RV parking is restricted to the specially designated RV lease pads only as identified on the Park site plan. - RVs must be maintained in good repair at all times without fluid leaks or obvious damage. - RV units older than 15 years from the date of manufacture are prohibited unless approved in writing by the manager. Severability - In the event that any of the Rules and Regulations set forth herein are deemed unenforceable for any reason, the remaining Rules and Regulations shall remain in full force and effect.

Cancellation Policy

MODERATE If the guest cancels at least 1 week before your check-in day and time, they will receive a full refund (minus Spot2Nite convenience or resort fees). If the guest cancels within the 1 week before check-in, there will be no refund.
