Check-In Procedure - Check-in time RV Sites: 1:00 p.m.-7:00 p.m. - Check-out time RV Sites: 11:00 a.m. - Check-in time Tiny Homes/Cabins: 4:00 p.m.-9:00 p.m. - Check-out time Tiny Homes/Cabins: 11:00 a.m. - Early check‑in and late check‑out are not guaranteed and require written approval. - Unauthorized late departure authorizes a $100 charge plus $50 for each additional half‑hour of continued occupancy. - While each park attempts to accommodate your exact spot request, the on-site manager has the ultimate decision for spot placement. Respect for Property and Community - Guests shall treat the Property, Resort, furnishings, landscaping, neighbors, and surrounding community with care and respect. - Any disrespectful conduct, misbehavior, or violation of community or POA rules may result in immediate termination of occupancy and removal without refund. Eligibility, Age, Responsible Party - The booking guest must be at least twenty-five (25) years of age and must remain an occupant for the entire reservation period. - Third‑party or proxy reservations for persons under 25 or for persons who will not occupy the Property are prohibited. - The Guest whose name appears on the reservation shall present government‑issued identification at check‑in when requested and is responsible for ensuring compliance with these Terms by all members of the party and invitees. - Stay Texas may cancel any reservation based on falsified identity, age, purpose, occupancy count, or other material misrepresentations. Occupancy, Visitors, and Extra Guests - Occupancy shall not exceed the maximum number of persons stated in the reservation confirmation or listing. - The count includes all overnight occupants and daytime visitors. - Visitor access may be limited based on capacity. - Per‑person, per‑day charges for visitors or extra guests may apply as published at booking and as reflected in the Resort Operational Schedule Addendum. - If occupancy limits are exceeded, Stay Texas may terminate the reservation without refund and assess a minimum service fee of $500 in addition to actual costs. Quiet Hours - Quiet hours are from 10:00 p.m. to 8:00 a.m. - Guests shall avoid excessive noise and disturbances at all times and shall not create noise audible beyond the lot line or in adjacent units. Events - Events, parties, weddings, commercial or promotional gatherings are prohibited without Stay Texas’s prior written consent. - Resort- or POA‑hosted events may occur and may temporarily limit amenity availability. Illegal Activity - Illegal activity of any kind is prohibited. - Internet use must comply with applicable laws. - Stay, Texas will cooperate with law enforcement. - Violations may result in termination without refund and a minimum $500 service fee plus actual costs, fines, and legal expenses Payments, Credit Card Authorization, Fees - Accepted methods: stay Texas accepts ACH and major credit cards and will only accept reservations if there is a valid credit card on file or if booked via a credible OTA (e.g., Airbnb, VRBO). - For direct bookings, these Terms control over any conflicting OTA terms. - Payment timing: 50% of the total payment is due at the time of booking, with another 50% due 30 days prior to the check-in date. - For reservations made 30 days or less prior to the check-in date, the full total will be collected. - Credit card transaction fees, stay Texas incurs approximately a 4% fee on each booking and a 4% fee on each refund. - For Guest‑initiated refunds, stay Texas may retain 8% of the original amount paid to cover such fees. Housekeeping - Units are cleaned and inspected prior to arrival and after departure by third‑party vendors. - Please leave units tidy, run the dishwasher, start towels, and refrain from rearranging furniture. - We require RV septic-safe toilet paper products to be used for all RV sites and tiny homes. Report issues promptly. Laundry - Laundry facilities operate during posted hours. - Do not hang clothes or towels on exterior lines or trees. Trash Removal - Place tied trash bags in the bin provided (if any) and set curbside on the concrete pad no later than 9:00 a.m. for daily pickup starting at 9:00 a.m. - Larger items must be taken to the dumpsters at the boulevard entrance. Equipment Failure - Stay Texas will act diligently to rectify issues within its control, but does not provide refunds for temporary mechanical failures or outages beyond its control. Damage Waiver - Each reservation includes a non‑refundable damage waiver that replaces any security deposit. - For Stay Texas – Fredericksburg, the damage waiver provides accidental damage coverage up to the amounts published at booking for the applicable unit type. Exclusions - The damage waiver does not cover negligent or intentional damage; theft without a valid police report; prior damage; normal wear and tear; animal or pest damage or infestation; or loss of use. - Stay Texas determines the nature/extent of damages, necessary repairs, and eligibility under the waiver, acting reasonably. Excessive Cleaning and Repairs. - Evidence of intentional excessive wear or required extraordinary cleaning authorizes Stay Texas to charge a minimum service fee of $100 for repairs or damages under $1,000, and a minimum of $500 for damages or repairs of $1,000 or more, plus actual costs (time, materials, vendor invoices, and replacement at market rates). Smoking - No smoking is permitted inside any structure. - Evidence of smoking inside authorizes a $500 smoke‑remediation fee in addition to any other cleaning or damage charges. Pets - Pet‑Friendly units, pets are permitted only in pet‑friendly units or sites and must be disclosed with the reservation. - The maximum is two (2) domesticated pets or qualifying service animals per reservation. - Pet fees vary by unit and dates and are published at booking. - Conduct and control, pets must be leashed at all times (not exceeding six (6) feet), may not be left unattended, and may not be tethered to utility fixtures, picnic tables, trees, or fences. - Pet owners must pick up waste and manage noise. - Aggressive behavior: Any pet exhibiting aggressive behavior toward persons or animals must leave the resort immediately without refund. - If any pet has exhibited aggressive behavior in the past, the guest must disclose that to Stay Texas prior to booking. - Vaccinations and records, pets must be up‑to‑date on vaccinations. - You must carry vaccination records and present them upon request from staff or property management. Recreational Equipment - Guests shall observe posted rules and exercise reasonable care. - Decks, patios, and stairs may be slippery when wet or icy. - No one under 25 may operate grills, barbecues, or fire pits. - No one under 18 may use pools or hot tubs without constant adult supervision. - Guests assume all risks associated with Recreational Equipment. Hot Tubs - Where applicable, follow special use instructions. - Towels must not be hung outside RVs or tiny homes. - Hot tubs are serviced and sanitized prior to arrival. - Neither the Property owner nor Stay Texas shall be liable for any injury or illness resulting from hot tub use. Parking - All vehicles must display a valid parking permit as directed. - Parking on streets is prohibited. - Personal vehicles must be parked on the concrete pad without impeding the street. - Overflow parking is not provided. Golf Carts - Guests bringing personal golf carts must carry valid insurance and provide proof upon request. - Failure to provide proof when asked may result in fees up to the amounts published at booking (up to $800). Number of Cars - Most sites accommodate two (2) vehicles on the concrete pad. - Bring as few vehicles as possible. RV Requirements - Pop‑up campers, truck campers, and tent camping are prohibited. - Class A, B, and C RVs; motorcoaches; travel trailers; and fifth wheels are permitted if ten (10) years or newer (certain classic restorations may be permitted with prior approval). - RVs must be at least twenty (20) feet in length. Common Areas, Hoa/poa Rules, Non‑smoking Areas - Stay Texas does not warrant the condition or availability of common areas. - Guests must comply with POA and posted rules. - Resort common areas and amenities (including the pool, clubhouse, and store) are non‑smoking. - You may smoke only at your site or in designated smoking areas. - Owners’ closets or other locked areas are reserved for owners’ private property and are not included in the rental. Access and Maintenance - Stay Texas and authorized vendors may enter the property at reasonable times to inspect, maintain, or repair the Property or address issues reported by guests. - Stay Texas will diligently attempt to address maintenance issues. Expedited Eviction and Termination - If a Guest fails to comply with these Terms, community/POA rules, or staff instructions, or engages in prohibited conduct, Stay Texas may immediately terminate the tenancy and eject the Guest without refund, subject to applicable Texas law. Responsible Party - The person named on the reservation must arrive with the party and remain on site for the entire stay. - Government‑issued ID may be required at the gate for entry. Relocation/Substitution - Because each site and accommodation is individually owned, owners may make decisions affecting reservation availability (e.g., upgrades, maintenance, reclassification, removal from the rental pool, or personal use). - Stay Texas may relocate the guest to a similar site or unit and will use commercially reasonable efforts to notify the Guest in advance. Sale/Unavailability - If a Property is sold, listed for sale, or otherwise becomes unavailable, Stay Texas may provide comparable accommodations at no additional cost or cancel and refund the reservation. Limited Short‑Term Rental - The Services constitute a short‑term vacation rental only and do not create a landlord‑tenant, fiduciary, principal‑agent, or other special relationship. - No rights of renewal, extension, or holdover are created. Subletting and assignment are prohibited. Texas Law - These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Venue - Venue for any dispute shall lie in a court of competent jurisdiction in Texas. Disclaimer of Landlord Obligations - To the extent permitted by Texas law, Stay Texas disclaims any duties or obligations imposed on landlords under Title 8, Chapter 92 of the Texas Property Code or other laws applicable solely to residential tenancies. Force Majeure, Attorneys’ Fees, Severability, Miscellaneous - Force Majeure, Stay Texas shall not be liable or responsible for any delay or failure caused by strike, insurrection, riot, unavoidable accident, civil disturbance, act of public enemy, embargo, fire, earthquake, flood, explosion, casualty, act of God, shortage of labor, materials or supplies, pandemic, outbreak of disease or contagion, war, governmental law, regulation or restriction, or any other cause beyond Stay Texas’s reasonable control that prohibits or makes impractical Stay Texas’s performance. - In such events, Stay Texas may cancel bookings, issue partial or full refunds or booking credits, or provide reasonable alternative accommodations. - No refund or credit is due for inclement weather, change of plans, bereavement, inconvenience, or other circumstances unless Stay Texas authorizes it. - Guests must comply with evacuation orders. - Attorneys’ Fees, if Stay Texas, the Property owner(s), or an authorized local property manager employs counsel to interpret or enforce these Terms, they are entitled to recover reasonable attorneys’ fees and costs from the responsible Guest(s). - Severability, Binding Effect, Assignment: if any provision is illegal, invalid, or unenforceable, the remaining provisions remain in effect. - These Terms bind and benefit the parties and their respective heirs, successors, and assigns. - You may not assign these Terms. - Entire Agreement, OTA Terms, these terms (including the Exhibits and Resort Operational Schedule Addendum) are the entire agreement for your stay. - For OTA bookings, these Terms control to the extent permitted, except where the OTA platform requires specific modifications that do not materially conflict with Stay Texas’s core rights. Resort Operational Schedule Addendum (Stay Texas – Fredericksburg) - Quiet Hours, 10:00 p.m. to 8:00 a.m. - Check‑In Windows, RV Sites 1:00 p.m.–7:00 p.m. - Tiny Homes/Cabins 4:00 p.m.–9:00 p.m., check‑out 11:00 a.m. for all. - After‑Hours Emergency Access, fees as published at booking. - Visitor/Extra‑Guest Charges, per‑person, per‑day rates as published at booking. - Pet Fees vary by unit and dates; published at booking (maximum two pets per unit/site; leash ≤ 6 ft; vaccination records required). - Damage Waiver Coverage Amounts (Resort‑Specific), published at booking for the applicable unit type; replaces prior Resort Fee terminology. - Trash Collection, daily pickup begins at 10:00 a.m.; place tied bags in the bin (if provided) and curbside by 9:00 a.m.; large items to dumpsters at the boulevard entrance. - Laundry Room Hours (if applicable): 8:00 a.m. to 8:00 p.m., no exterior clotheslines. - Pool Hours: The pool is open to guest use from 10:00 am to 9:00 pm. - Swimming is at your own risk. Mandatory Evacuation - If state or local authorities order a mandatory evacuation that includes the property, you must comply. - Upon compliance, you are entitled to a refund of the pro‑rated rent for each night you are unable to occupy the Property because of the order, consistent with applicable law. Items Left Behind, Mail and Packages, Owners’ Closets - Guests should collect all belongings prior to checkout. - The Resort cannot store unclaimed items; items not claimed within twenty‑four (24) hours may be discarded. - The Resort cannot accept mail or package delivery to individual sites. - Extended‑stay Guests should arrange off‑site delivery; staff may suggest nearby PO boxes or parcel services upon request. - Any locked closets or other locked areas are reserved for owners’ private property and are excluded from the rental. Safety, Burn Bans, Restrooms, and Showers - During officially posted burn bans, fires are not permitted. - Observe all safety notices and signage. - Restroom and shower suites are available at the amenity center, subject to posted hours and maintenance. Coverage - Stay Texas Vacation Rentals has assumed responsibility for accidental damages as outlined below and waives your security deposit up to the Damage Waiver limit published at booking for the applicable unit type during your stay at the property. - This is not insurance; it is a waiver of a security deposit otherwise due. - Exclusions: Acts of God, normal wear and tear, theft without a valid police report, loss of use, rodent, termite, bed bug, or other animal damage or infestation, prior damage, or damage/theft of your property are excluded. - Conditions, Stay Texas reasonably determines the nature and extent of damages, required repairs, and eligibility. - The Waiver applies only to the one‑time, continuous stay purchased; it begins upon occupancy and ends upon departure. - Theft or damage must be reported within three (3) days of departure. - Stay Texas will not respond to damage below the per‑occurrence threshold published at booking; if above, Stay Texas will respond up to the applicable Waiver limit. - Mediation is required before litigation; a jury trial is waived where lawful. Definitions and Interpretation - Services means vacation rental management, marketing, reservation handling, maintenance coordination, guest communications, and other related or incidental services provided by Stay Texas on behalf of Property owners. - Common Areas means shared amenities owned or maintained by the owners’ association or site owners, including, without limitation, the pool, clubhouse, landscaped areas, and other amenities as posted or made available. - Recreational Equipment means, without limitation, rooftop decks, patios, grills or fire pits, pools, hot tubs, and exercise equipment located at or serving the property. - Headings are for convenience and do not affect interpretation. - The singular includes the plural and vice versa.

Cancellation Policy

Cancellation Policy Stays shorter than 28 nights - Cancelling your reservation on the day of or within 7 days prior to arrival will result in no refund. - Cancelling your reservation 8 to 14 days prior to arrival, the guest will be refunded half of their total stay. - Cancellations 15 or more days will receive a full refund minus a $15 processing fee. Stays longer than 28 nights - Please contact the office for cancellations. - Every monthly/extended stay is subject to $50 non-refundable fee. Refund Policy - There will be no refunds after you have checked in, for inclement weather, failure to follow the Rules & Regulations, or disorderly conduct. - Manager/Owner reserves the right to have discretion on all refunds. - All Spot2Nite reservations require payment in full at the time of booking. - Please contact Spot2Nite to cancel a reservation via email to [email protected] or call (877)778-2683, Option 1. - Spot2Nite convenience fees and credit card processing fees are non-refundable.
